All suggestions and/or comments relating to the use of equipment, poses, moves and instruction are not required to be performed by you and are carried out at your election. Nothing contained in this website should be construed as any form of such medical advice or diagnosis.

By using the website, you represent that you understand that physical exercise involves strenuous physical movement, and that such activity carries the risk of injury whether physical or mental. You understand that it is your responsibility to judge your physical and mental capabilities for such activities. It is your responsibility to ensure that by participating in classes and activities frompilatesinapencilskirt.com you will not exceed your limits while performing such activity, and you will select the appropriate level of classes for your skills and abilities, as well as for any mental or physical conditions and/or limitations you have. You understand that, from time to time, instructors may suggest physical adjustments or the use of equipment and it is your sole responsibility to determine if any such suggested adjustment or equipment is appropriate for your level of ability and physical and mental condition.

You expressly waive and release any claim that you may have at any time for injury of any kind against pilatesinapencilskirt.com, or any person or entity involved with pilatesinapencilskirt.com, including, without limitation, its directors, principals, instructors, independent contractors, employees, agents, contractors, affiliates and representatives.

Limitation on Liability

In no event shall pilatesinapencilskirt.com, its instructors, staff, officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the website, (iii) any unauthorized access to or use of pilatesinapencilskirt.com’s secure servers and/or any and all personal information and/or financial information stored therein/thereon, (iv) any interruption or cessation of transmission to or from the website, (v) any bugs, viruses, Trojan horses, or the like, which may be transmitted to or through the website by any third party, and/or (vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the website, whether based on warranty, contract, tort, or any other legal theory, and whether or not we are advised of the possibility of such damages. Cancellation Policies (this is only for people who sign up for paid membership)

Monthly Membership: You will be automatically re-enrolled and billed each month. Due to the digital nature of the content, there are no refunds, but you can cancel your membership at any time.
Annual Membership: After purchasing the program, you have 30 days to cancel for a full refund. After 30 days, there are no refunds.

Live Virtual 1:1 Pilates Classes Agreement

Welcome to my Live Virtual 1:1 Pilates Classes!

HOW WE WORK TOGETHER:

● 12 x 45-minute live private Pilates zoom sessions within 3 months

FEE SCHEDULE:

The cost is $1020 for 3 months (12 sessions).

You can either choose to purchase all of the sessions in one payment today

OR

You can divide the payments by paying $340 per month for three (3) months (12 sessions). If you choose to divide the payments, you will be charged for the first payment today. You will then be automatically charged for the second payment in exactly 1 month from today, and automatically charged again for the third payment in exactly 2 months from today.

1. As a client, I understand and agree that I am fully responsible for my physical, mental and emotional well-being during my Pilates sessions, including my choices and decisions.
2. I understand that Pilates class does not involve the diagnosis or treatment of physical or mental disorders. I understand that Pilates class is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment and I will not use it in place of any form of diagnosis, treatment or therapy.

CANCELLATION POLICY:
Client agrees that it is the Client’s responsibility to notify the teacher 24 hours in advance of the scheduled class time if they need to cancel a Pilates session. The Teacher reserves the right to bill the Client for the missed session if the class is not canceled at least 24-hours in advance.
Client agrees that if the Client is late to a scheduled session, the Teacher will not refund the Client for that missed session time.

TERMINATION:
Either the Client or the Teacher may terminate this agreement at any time with 15 days written notice. Pre-paid sessions are non-refundable and notice must be received by the Teacher by the 15th of the month to cancel services for the following month.

LIMITED LIABILITY:
Except as expressly provided in this agreement, the Teacher makes no guarantees or warranties, express or implied. In no event will the Teacher be liable to the Client for consequential or special damages. Notwithstanding any damages that the Client may incur, the Client’s entire liability under this agreement, and the Client’s exclusive remedy, will be limited to the amount paid by the Client to the Teacher under this agreement for all services rendered up until the termination date.
This is the entire agreement of the parties, and reflects a complete understanding of the parties with respect to the subject matter. This agreement supersedes all prior written and oral representations.
If a dispute arises out of this agreement that cannot be resolved by mutual consent, the Client and Teacher agree to attempt to mediate in good faith for up to 30 days after notice is given. If the dispute is not resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party.

All suggestions and/or comments relating to the use of equipment, poses, moves and instruction are not required to be performed by you and are carried out at your election. Nothing should be construed as any form of such medical advice or diagnosis.

In working with Lisa Silverstein, either in person or via live zoom, you represent that you understand that physical exercise involves strenuous physical movement, and that such activity carries the risk of injury whether physical or mental. You understand that it is your responsibility to judge your physical and mental capabilities for such activities. It is your responsibility to ensure that by participating in classes and activities from Pilates in a Pencil Skirt Studios you will not exceed your limits while performing such activity, and you will select the appropriate level of classes for your skills and abilities, as well as for any mental or physical conditions and/or limitations you have. You understand that, from time to time, instructors may suggest physical adjustments or the use of equipment and it is your sole responsibility to determine if any such suggested adjustment or equipment is appropriate for your level of ability and physical and mental condition.
